Terms & Conditions

Revival by Design Ltd – Terms & Conditions

These Terms & Conditions govern the agreement between Revival by Design Ltd (“we”, “us”) and the client (“you”). By making payment, you accept these Terms and the Scope of Works provided to you.

 

1. Definitions

  • Contract: These Terms and any proposal, schedule or written Scope of Works.

  • Goods: Any furniture, furnishings, fabrics or items supplied or procured by us.

  • Services: Any design, procurement, installation or related services provided by us.

  • Scope of Works: The description of services and deliverables as outlined in our proposal.

  • Third Party Supplier: Contractors, tradespeople, builders or suppliers engaged directly by you.

  • Design Intent: The overall style, concept and direction communicated through our design documents

2. Scope of Works

We will undertake the Services listed in the Scope of Works. Anything not expressly stated is excluded and may incur additional costs.

3. Intellectual Property

All designs, drawings, visuals and documents remain our property. You may not use them with other designers or trades, nor reproduce or distribute them without permission.

4. Designs & Drawings

Designs are conceptual unless otherwise stated. They are not technical drawings and may not be to scale. Final items may vary based on availability, supplier changes and budget.

5. Client Responsibilities

You must:

  • Provide accurate information.

  • Ensure the property is safe, accessible and insured.

  • Verify that items will fit through access points.

  • Provide approvals and feedback within 14 days.

6. Site Conditions

We accept no liability for pre-existing issues, including structural defects, damp, electrical or plumbing problems, or conditions not visible during design.

Additional costs arising from inaccurate or changing site conditions are your responsibility.

7. Third Party Suppliers

You contract directly with any Third Party Suppliers. We accept no liability for their performance or workmanship.

​

8. Approvals & Revisions

One revision per design phase is included unless stated otherwise. Additional revisions or changes to the brief may incur fees.

​

9. Procurement & Substitutions

Goods are ordered once payment is received. Where items are unavailable or pricing changes occur, we may substitute items that maintain the design intent and budget.

Lead times are estimates only.

10. Delivery & Installation

We are not liable for minor scuffs or incidental damage that may occur during delivery or installation where access is restricted.

If items cannot be delivered due to access constraints, they cannot be returned or refunded.

11. Storage

If delivery or installation cannot take place due to client circumstances, storage and re-delivery fees may apply. Risk transfers to you upon attempted delivery.

​

12. Bespoke & Made-to-Measure Items

Custom items cannot be cancelled or returned. Variations in shade, size and texture are normal.

​

13. Fabrics

Batch variations, fading, pilling and movement (up to 3%) are normal. After-purchase fabric treatments void responsibility.

​

14. Payments

Payment terms are set out in the proposal.
Design fees and deposits are non-refundable.
Goods remain our property until paid for in full.

Late payments may pause the project and incur interest at 8% above the Bank of England base rate.

15. Cancellations

Payments made up to the date of cancellation are non-refundable.
Refunds (if any) may incur cancellation fees of 50% or more.

​

16. Warranties

We pass on manufacturer warranties where applicable. No additional warranties are provided.

​

17. Photography

We may photograph the completed project for marketing unless you request otherwise in writing.

​

18. Timeframes

Estimated timeframes are not guaranteed. We accept no liability for delays due to suppliers, Third Party Suppliers or client delays.

19. Liability

Our liability is limited to the amount covered by our insurance. We are not liable for consequential or indirect loss.

​

20. Dispute Resolution

Disputes will be addressed first through discussion, then mediation, then arbitration.

​

21. Privacy

We comply with UK GDPR. Personal data is stored securely and used only for providing Services.

​

22. Force Majeure

We are not liable for delays caused by events outside our control, including pandemics, strikes, supply chain disruption, weather or similar events.

​

23. General

This Contract is governed by English law. No third party has rights under this agreement.
